Terms of Use

1. Introduction

Who we are.
These Terms of Use (“Terms”) govern your access to and use of the Uchim website, mobile apps and related services (collectively, the “Service”), operated by:

Agreement.
By creating an account, installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please also review our Privacy Policy (how we process personal data) and any supplemental policies referenced here. In case of conflict, specific product- or region-specific terms prevail over these Terms.

Consumer information.
If you are a consumer in the EU/EEA/UK, you may have statutory rights that cannot be waived; these Terms apply only to the extent permitted by applicable law.

Language.
These Terms are drafted in English and shall prevail in case of discrepancies with any translations.

2. Eligibility & Account

Age.
You must be at least 16 years old (or older if required by the laws of your country) to use the Service. If you are under 18, you confirm that you have parental/guardian consent.

Account.
You are responsible for safeguarding your login credentials and for all activities under your account. Notify us immediately of unauthorized use.

Accuracy.
You must provide accurate information and keep it up to date (e.g., email for account recovery and legal notices).

3. License & Use of the Service

License.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app(s) and access the Service for your personal, non-commercial language-learning purposes.

Restrictions.
You must not (and must not permit others to): copy, modify, reverse engineer, decompile, disassemble, or create derivative works of the Service; circumvent security or access controls; use automated means (scrapers, bots) except as expressly permitted; rent, lease, sell, sublicense, or otherwise transfer rights in the Service.

Educational content.
The Service provides educational material and exercises. Results and suggestions may contain errors; always verify critical information. The Service does not provide legal, medical, or professional advice.

4. User Content & Conduct

Your content.
You may submit or create content (e.g., profile data, notes, recordings, messages) (“User Content”). You retain ownership of User Content. By submitting, you grant Uchim a worldwide, non-exclusive, royalty-free license to host, store, display, perform, adapt, and otherwise use your User Content solely to operate and improve the Service.

Acceptable use.
You agree not to upload or share content that is illegal, infringing, hateful, harassing, defamatory, pornographic, or otherwise objectionable; not to impersonate others; not to violate third-party rights (privacy, IP, publicity); not to interfere with or disrupt the Service.

Moderation.
We may remove or disable access to User Content that violates these Terms or the law and may suspend or terminate accounts in accordance with Section 12.

5. Subscriptions, Trials & Payments

Subscriptions.
Some features may require paid subscriptions or one-time purchases. Prices, currencies, billing periods, and benefits will be shown at the point of purchase.

Trials & promotions.
If you start a trial, it may convert to a paid subscription at the then-current price unless you cancel before the trial ends.

Auto-renewal & cancellation.
Subscriptions renew automatically unless canceled in your platform account (App Store/Google Play) or app settings at least 24 hours before the end of the current period. Deleting the app does not cancel a subscription.

Refunds.
Refund handling follows platform rules (App Store/Play) and applicable consumer law. Where required by law, you may have a right of withdrawal for digital content not yet provided; details and instructions will be presented at checkout if applicable.

21. Right of Withdrawal (EU/EEA/UK Consumers)

Withdrawal policy.
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us (Uchim – Lukas Stoll, Rhoenstrasse 17, 71083 Herrenberg, Germany, email: hi@uchim.app) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.

Effects of withdrawal.
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (if any), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result. If you requested that the Service begin during the withdrawal period, you shall pay us an amount proportionate to the use provided until the time you communicated your withdrawal.
